In an interview with The Christian Science Monitor about whether President Trump’s travel ban will withstand constitutional muster, Professor Steven Schwinn said that the federal judges hearing arguments about the travel ban may find some of the president’s extrajudicial comments about the ban persuasive in their decisions. “Can the court look behind the executive order at what President Trump and other administration officials said during the campaign and after, or is the court limited to the face of the executive order?” Schwinn said. “The entire case turns on that.”
