Associate professor Steven Schwinn at The John Marshall Law School in Chicago said he understands why the courts would create the list but finds it “problematic.”
“I kind of recoil when I hear of any program like this,” he said, “because we’re trading on fundamental rights basically for efficiency reasons.”
