There are two interesting issues in this case. One is on the merits. The question there is, is the federal definition of marriage under the DOMA? It defines marriage as only between one man and one woman, and thereby excludes same-sex marriage. Is that constitutional? The other issue in the case is a jurisdictional issue. Does the court have jurisdiction, given the very unique posture of the case?
