“The courts have been very forgiving and deferential to governments in using their rights of eminent domain,” says Steven Schwinn, an associate law professor with the John Marshall Law School. “Where it draws the line is if the city takes property and for no good reason gives it to someone else – a naked transfer of wealth.”
